01Scope and who we are

CAL Marketing LLC (“CAL Marketing,” “we,” “us,” or “our”) provides marketing, consulting, automation, software, subscription, and related digital services (the “Services”). This Policy describes our processing of personal information when we determine why and how that information is handled.

CAL Marketing operates offerings that may be presented under CAL Marketing, CIKVI, AIVRYA, and LIYNO. This Policy applies to those operated brands unless a separate notice expressly provides otherwise.

02Information we collect

The personal information we collect depends on how you interact with us and may include:

  • Contact and identity information, such as your name, email address, telephone number, company, job title, and account identifiers.
  • Account and client information, including credentials, preferences, project details, instructions, forms, files, and content you submit.
  • Commercial and billing information, such as purchases, subscriptions, invoices, payment status, and transaction records.
  • Communications, including inquiries, support requests, meeting details, feedback, and other correspondence.
  • Technical and usage information, including IP address, device and browser information, log data, pages viewed, referring URLs, approximate location derived from IP address, and interactions with the Services.
  • Integration information, including data from CRM, advertising, analytics, marketing, scheduling, or other accounts you authorize us to access.

03Sources of information

We collect information directly from you; automatically through your use of the Services; from the organization you represent; and from service providers, integrations, business partners, public sources, or other third parties where permitted by law.

If you provide personal information about another person, you are responsible for having the authority to do so and for providing any notice required by law.

04How we use information

We may use personal information to:

  • provide, personalize, maintain, support, and improve the Services;
  • create and administer accounts, projects, subscriptions, invoices, and transactions;
  • communicate about inquiries, support, service updates, security, and our business relationship;
  • send marketing communications where permitted by law and honor opt-out requests;
  • measure performance, understand usage, improve workflows, and develop offerings;
  • secure the Services and detect, investigate, and prevent fraud, abuse, unauthorized access, or other harmful activity;
  • comply with law, enforce agreements, resolve disputes, and protect rights, safety, and property; and
  • carry out another purpose disclosed when the information is collected or with your direction or consent.

05Legal bases for processing

Where applicable law requires a legal basis, we process personal information as necessary to perform a contract or take requested steps before entering one; comply with legal obligations; pursue legitimate interests that are not overridden by your rights; or act with consent.

Our legitimate interests may include providing and improving the Services, communicating with customers and prospects, securing systems, preventing fraud, conducting analytics, and operating our business. Where processing relies on consent, you may withdraw that consent at any time, without affecting earlier lawful processing.

06Cookies and tracking technologies

We and our service providers may use cookies, pixels, tags, scripts, local storage, analytics tools, and similar technologies to operate the Services, remember preferences, understand traffic and usage, measure campaigns, and support marketing.

You may be able to control cookies through browser settings or any consent controls presented on a Service. Blocking some technologies may affect functionality. Browser “Do Not Track” signals are not interpreted consistently across the industry; where required, we respond to legally recognized opt-out preference signals.

07How we disclose information

We do not sell personal information for money. We may disclose information as reasonably necessary to:

  • hosting, cloud, security, communications, analytics, CRM, scheduling, advertising, automation, and other vendors that support our business;
  • professional advisers such as attorneys, accountants, auditors, and insurers;
  • business partners or integrations at your direction or as needed to provide a requested Service;
  • government authorities, courts, or other parties when required by law or reasonably necessary to protect rights, safety, or property; and
  • actual or prospective buyers, investors, lenders, or successors in connection with a financing, merger, acquisition, restructuring, bankruptcy, or sale of assets.

Some privacy laws define “sale,” “sharing,” or “targeted advertising” more broadly than an exchange for money. Where those laws apply, you may have the right to opt out as described below.

08Payments and billing providers

Payment transactions may be processed by third parties, including Stripe. Payment providers collect and process payment information under their own privacy and security practices. We generally receive limited billing information, such as customer and transaction identifiers, payment status, subscription status, invoice details, and related metadata, rather than full payment-card details.

09Data retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide Services, administer accounts and billing, maintain business and tax records, resolve disputes, enforce agreements, and comply with law.

Retention periods vary based on the nature and sensitivity of the information, the purposes for processing it, contractual and operational needs, applicable limitation periods, and legal requirements. When information is no longer needed, we may delete or deidentify it, subject to backup and archival cycles.

10Data security and international processing

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure. No system, transmission, or storage method is completely secure, and we cannot guarantee absolute security.

We and our service providers may process information in the United States and other countries whose laws may differ from those where you live. Where required, we use recognized safeguards for international transfers. You are responsible for protecting your devices, credentials, integrations, and access permissions.

11Your rights and choices

Depending on your location and applicable law, you may have rights to request access to, correction of, deletion of, or a portable copy of certain personal information; restrict or object to certain processing; withdraw consent; or opt out of certain sales, sharing, targeted advertising, or profiling.

You may unsubscribe from marketing emails using the link in the message. Transactional and service communications may continue when necessary. To submit another privacy request, use the contact method in Section 14 and describe your request and relationship with us.

We may verify your identity and authority before acting. An authorized agent may submit a request where permitted, subject to proof of authority and identity verification. We may deny or limit a request where an exception applies and will explain the decision when required. You will not be unlawfully discriminated against for exercising a privacy right. Where applicable, you may appeal a denied request by replying to our decision.

12Children’s privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 through our public-facing Services. If you believe a child has provided personal information to us, contact us so we can review and take appropriate action.

13Changes to this Policy

We may update this Policy to reflect changes in our Services, practices, technology, or legal obligations. We will post the revised version and update the effective date. If a change is material, we may provide additional notice where reasonably practicable or required by law.

14Contact and privacy requests

Questions about this Policy and requests relating to personal information should be submitted through the contact or support channel displayed on the applicable CAL Marketing website, account, proposal, order form, or invoice. Please include enough information for us to understand and respond to your request, but do not send sensitive information through an unsecured channel.
